The Supreme Court responds on the rejection of exhumation requests for Tempi victims

  1. Greece’s Supreme Court (Areios Pagos) has stated that it cannot grant the request of parents of the Tempi train crash victims for exhumations to investigate whether flammable material is present in the remains, as this falls under the investigative process, which has now been closed.
  2. Any such request, the court clarified, can only be made if the investigative process is reopened during the trial.
  3. While the investigation was still open, until the case file was handed over to the appellate prosecutor, three requests for exhumation had been filed and rejected, according to “Kathimerini”.

The leadership of Greece’s Supreme Court (Areios Pagos) stated that the request by parents of the Tempi train crash victims for exhumations, so that bones could be examined for traces of flammable material, cannot be granted, as this is a matter of the investigative process, which has now closed.

“The exhumation is requested within the framework of the investigation, but the investigation has closed. The case file is now with the Prosecutor’s Office, so that relatives may submit memoranda, and then it will go to the President of the Court of Appeals to decide whether the defendants will be referred to trial, or whether further acts will be ordered and the investigation reopened”, said Supreme Court President Anastasia Papadopoulou.

Meanwhile, Panos Routsis has entered the 10th day of a hunger strike, demanding the exhumation of his son, who was among the victims of the Tempi tragedy.

She clarified: “No rights are lost. Any application filed during the investigation and rejected by the investigating judge, whether rightly or wrongly, can be submitted again in court. Once the trial begins, all previously rejected requests, as well as new ones, can be presented”.

Supreme Court Prosecutor Konstantinos Tzavelas added: “The exhumation of remains from a grave in order to determine whether they contain traces of flammable material is a request that cannot be granted. It is a matter of the main investigation, which has already been repeatedly decided”.

According to “Kathimerini“, while the investigative process was still open and before the case file was handed over to the appellate prosecutor, three exhumation requests had been filed, all of which were rejected.
