Alexandros Giotopoulos has returned to prison after the Supreme Court overturned the ruling that had led to his release three weeks ago following a decision by the Piraeus Court of Appeals Council. Yesterday afternoon, he left his home with his lawyer heading for Korydallos Prison, but it was ultimately decided that he should return to the Athens Police Headquarters (GADA), and today he is being brought before the Piraeus Appeals Prosecutor.

In the ruling that led to Giotopoulos’ release, the Piraeus appellate judges had found that he fell under the legal framework in force before 2021, which required 19 years of imprisonment before a prisoner could apply for release.

However, it was subsequently determined that there had been an incorrect application or interpretation of the law governing his release and that the ruling did not sufficiently justify the reasons for granting parole.

In their ruling, the Piraeus appellate judges had found that Giotopoulos was covered by the legal framework in force before 2021, which required 19 years of imprisonment before a prisoner could apply for release.

As a result, although Giotopoulos has completed 24 years in prison, the Supreme Court concluded that he falls under Law 4855/2021, which requires the completion of 25 years of imprisonment before release. Specifically, the law states: “A convicted person serving multiple life sentences may be released if they have served twenty-five (25) years.”

The appeal seeking the annulment of the release ruling was filed by Supreme Court Deputy Prosecutor Sofoklis Logothetis.

Alexandros Giotopoulos, also known as “Lambros” of the “November 17” organization, was convicted as a leading figure of the group and sentenced to seventeen life terms in prison, in addition to a further 25-year sentence.
